June 22 – Canada: Health Canada CCCR Product Recall

Product: Outdoor Wood Furnace Boiler Treatment Product

Health Canada’s auditing process has revealed that the recalled product is corrosive and does not meet the labelling and child-resistance closure requirements for this type of consumer chemical, as per Canadian law.

The lack of child-resistant closures and appropriate warning labels, including French text, could result in unintentional exposure to this product and lead to serious illnesses or injuries.

June 17 – Canada: How Bill C-36 differs from the former Bill C-6

From Health Canada – Key Elements of the Proposed Canada Consumer Product Safety Act:

The Government has listened to the issues raised by some stakeholders and parliamentarians and has amended the Bill. These amendments do not compromise the spirit of the Bill nor the level of protection it would provide to Canadians.

The amendments include the following:

  • The term “storing” has been defined in order to clarify that Health Canada inspectors’ authorities would not extend to products that individuals store for their personal use.
  • The original Bill stated that a product safety inspector could pass through or over private property while carrying out their functions without being liable for doing so. The amendment to the trespass provision addresses concerns by removing the phrase “and they are not liable for doing so.”
  • An amendment has been made so that the Minister of Health, not a product safety inspector, would be accountable for ordering product recalls and other related measures.
  • An amendment has also been made to further define the time frame for the review of orders. Under the previous Bill, a review officer was required to complete the review “within a reasonable time.” This has now been further defined to say: “no later than 30 days after the day on which the request is provided to the Minister.”

June 17 – US: Unsafe Lead Levels Found in Childrens Juices

From Food Safety News:

The Environmental Law Foundation filed Notices of Violation of California Proposition 65 Toxics Right to Know Law this month, alleging the toxic chemical lead was found in a variety of children’s and baby foods.

The notice claims that the children’s foods contain enough lead in a single serving that the products require a warning under California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (“Proposition 65″ or “Prop 65″).

Under Prop 65, the Governor publishes a list of chemicals “known to the State to cause cancer or reproductive harm.” Lead is listed as both and was among the first substances listed in 1987. According to Before It’s News, if any consumer product contains a listed chemical at a level that presents a “significant risk” the manufacturer and retailer must give a “clear and reasonable warning” about the exposure.

June 16 – Canada: New Canada Consumer Product Safety Act (Bill C-36)

Canada’s Health Minister Leona Aglukkaq re-introduced Bill C-36 (the old Bill C-6) into parliament on Wednesday June 9, 2010. The new bill will once again have to be passed through the House of Commons and the Senate before it can become law.

Nexreg is currently reviewing the amended Bill as well as awaiting the release of guidance documents for the CCPSA from Health Canada. We will inform you of any important changes we discover as well as post any new information that becomes available.

June 16 – Canada: Government of Canada Delivers on Commitment for Tougher Consumer Product Safety

[On June 9, 2010] the Government of Canada introduced a tough new Bill to beef up Canada’s out-of-date product safety laws and deliver stronger, more effective protection for Canadian consumers and their families. The proposed Canada Consumer Product Safety Act (CCPSA) was introduced…in the House of Commons by the Honourable Leona Aglukkaq, Minister of Health.

The new proposed Canada Consumer Product Safety Act would improve consumer product safety with action that includes:

  • Prohibiting the manufacturing, importing, marketing or selling of any consumer products deemed or proven unsafe to human health or safety;
  • Requiring industry to quickly inform the government when they discover one of their products is linked to a serious incident, death, or product safety issue;
  • Requiring manufacturers or importers to provide test/study results on products when asked;
  • Empowering Health Canada to recall unreasonably dangerous consumer products; and
  • Making it an offence to package or label consumer products that make false or deceptive health or safety claims.

The proposed Canada Consumer Product Safety Act builds on Bill C-6, which the Government previously introduced, and takes into account concerns raised by some stakeholders and parliamentarians through specific amendments. These amendments serve to clarify the intent of the Bill…

June 4 – Canada: Minister of Health to visit Product Safety Lab for consumer product testing demonstration

Monday June 7, 2010 at 10:30am the Minister of Health, Leona Aglukkaq, is going to visit Health Canada’s Product Safety Laboratory in Ottawa for a demonstration of testing conducted on consumer products.

June 4 – California: Withdrawal of Prop 65 regulatory proposal

From the OEHHA:

The Office of Environmental Health Hazard Assessment (OEHHA) hereby announces the withdrawal of its regulatory proposal for possible amendments to Sections 25801, 25803 and 25805 of the Proposition 65 implementing regulations. These sections establish the procedures for calculating safe harbor levels for chemicals listed under Proposition 65…OEHHA has determined that significant changes will be made to the proposal and is therefore withdrawing it at this time. OEHHA will provide notice and an opportunity to comment prior to beginning any formal regulatory process related to this proposal…

June 2 – US: Vermont Enacts Law Banning Bisphenol A

From the Bureau Veritas Group:

The Governor of Vermont has signed a law banning Bisphenol A (BPA) from certain products. Beginning on July 1, 2012, the law bans reusable food or beverage containers composed of BPA such as baby bottles, spill-proof cups, thermoses, and sports bottles. It also bans infant formula or baby food stored in plastic containers or jars containing BPA as of July 1, 2012 and then extends the ban to infant formula or baby food stored in cans containing BPA as of July 1, 2014. The law also prohibits using specified carcinogens or reproductive toxins as alternatives to BPA, and requires use of the least toxic alternatives.
