California’s Prop 65 Update

California’s Office of Environmental Health Hazard Assessment, commonly known as Oehha, is meeting to consult on proposed amendments that would help clarify the content required in notices of violation under Proposition 65.

 

It is noted that many businesses are failing to give both ‘clear and reasonable’ warning, prior to exposing an individual to a substance that is listed under Prop 65.

 

The proposal calls for amendments to clarify the information required in a valid notice of violation, including the amendment of the content in NOVs, involving occupational exposure and the cross-reference mandatory language required under occupational health regulations.

 

Another section proposes moving to a separate appendix, compliance procedural forms, that must be used for certain exposures.

 

Comments on the amendments will be accepted until July 3, 2017.
