National Regulations Governing Labels:
Denmark is a member of the European Union and as such is bound by EU regulations. For pure substances, Austrian labels must be compliant with the EU’s GHS based CLP-regulation No. 1272/2008 – labels created to be compliant with Directive 67/548/EEC have expired. For mixtures, labels can be compliant with either 1272/2008 or with the previous Directive 1999/45/EC.
In Denmark the majority of existing chemical law is common to the EU. However, there are a number of executive orders relating to heavy metals, greenhouse gases and protective equipment which may vary from current EU legislation. Denmark is known for its tough stance on consumer protection. For this reason it is important to be informed on additional regulations, and relevant legislation. The Danish Consumer Ombudsman is “an independent public authority which supervises compliance with Danish marketing law”. The Consumer Ombudsman contains guides for business and consumer, as well as an English version of the Danish Marketing Practices Act; described as the most important piece of legislation concerning marketing content and activities. Also contained within the Ombudsman is a structure for consumer complaints, news, and relevant contacts.
GHS Implementation Status:
The EU has fully adopted GHS under their CLP Regulation (Regulation on classification, labeling and packaging of substances and mixtures). The deadline for having new Labels has passed for pure substances – it was November 30, 2010. The deadline for mixtures is May 31, 2015. Not all the building blocks in the United Nations’ Purple Book were adopted by the EU CLP regulation.
