Employers in the United States must continue to comply with the Occupational Safety and Health Administration (OSHA), despite the delays in the enforcement dates due to the recent Trump administration.
Last week, the administration announced the delay of its silica standard because of the need to provide additional guidance to silica’s requirements in the industry.
The rule, known as the Occupational Exposure to Respirable Crystalline Silica Rule, reduces the exposure limit to the substance over an eight-hour shift to 50 micrograms per cubic metre of air for the construction industry. This is one-fifth of the previous maximum.
Despite the delay, the administration has made it clear that it expects the employers to continue to take the steps in becoming compliant with the new exposure limit or to follow table 1 of the standard for dust controls.
However, the beryllium rule is still within the review period Congressional Review Act as Congress and US President Donald Trump have already expressed their willingness to use this particlur tool, including OSHA’s Volks rule, which allows employers to have a record of every injury and illness in the workplace over the last five years.
