The US Environmental Protection Act (EPA) is creating significant new use rules (Snurs) under the reformed Toxic Substances Control Act (TSCA) for 37 substances that were apart of the pre-manufacture notices.
The new rules require those who intend to manufacture any of the 37 chemical substances for any activity that is designated as a significant new use by the rule must notify the EPA at least 90 days before starting the activity.
Six of the 37 chemicals are subject to TSCA section 5(e) consent orders issued by the EPA. The six chemicals include:
– pyrolysis oil product;
-butanedioic acid, alkyl amine, dimethylbutyl ester;
-nanocarbon (generic);
-1-propene, 2-bromo-3,3,3-trifluoro-;
-substituted alkanolamine ether; and
-carbon nanotube (generic).
Manufacturing and processing for the significant new use cannot commence until the EPA has finished conducting the review of the notice. However, the rule is set to become effective on November 20, 2017.
