In the United States the Authority responsible for consumer labeling of chemical substances is the Consumer Product Safety Commission. Chemical substances intended for consumer use should be labeled according to the provisions in the Federal Hazardous Substance Act (FHSA) and the Consumer Product Safety Act (CPSA).
In California Proposition 65 “Safe Drinking Water and Toxic Enforcement Act of 1986” requires that you determine whether any of the hazardous chemicals within a chemical formula are subject to Proposition 65 requirements.
Some hazardous products may also fall under the Poison Prevention Packaging Act.
The new Hazard Communication Standard (Hazcom 2012) will bring the US more in line with the UN GHS based system. There is currently a transition period from 2013 to 2016 for all chemical manufacturers, importers, distributors and all employers to conform to the new standard. By June 1st, 2016 everyone must comply with the modified provisions of the final rule.
