National Regulations Governing SDSs/MSDSs: 

In New Zealand the Ministry of Business Innovation and Employment has prepared a “Code of Practice for the Preparation of Safety Data Sheets (SDS) (HSNOCOP 8-1)”. This code will enable compliance with the Hazardous Substances Regulations 2001, sections 37 to 50. The code will also enable compliance for the Hazardous Substances (Emergency Management) Regulations 2001, and the Hazardous Substances (Disposal) Regulations 2001, sections 12 to 20 and 13 to 14 respectively.

Additional Regulations: 

The above mentioned regulations contain additional provisions in regards to chemical management. Further, chemicals are regulated under the following acts:

  • Hazardous Substances and New Organisms (HSNO) Act 1996
  • Health and Safety Employment (HSE) Act 1992
  • Resource Management Act (RMA) 1991

The transport of hazardous substances is covered by the Land Transport Rule: Dangerous Goods 2005(Rule 45001/1), as amended by Rule 45001/2.
