California’s Office of Health Hazard Assessment (OEHHA) have now issued the new regulations for Safe Harbor under Proposition 65.
Taking effect on August 30, 2018, the new regulations aim to provide the consumers with more specific information about the chemicals they are buying in California.
Between now and August 2018, manufacturers will have two options when it comes to the new regulations. Option number one is that they can continue using the language that is required under the current safe harbor regulation, as long as the product is manufactured before August 2018. The second option is that manufacturers can start using the new warning language immediately.
The new regulations will require:

- Manufacturers to list the names of one or more chemicals under Prop 65 that trigger the warning label requirements;

- The pictograms must accompany the label in the form of a black exclamation point in a yellow equilateral triangle that must be outlined black;

- That the language used, catches the consumers’ attention. The warning must be written in at least 6- point font and be no smaller than the largest font used for other information on the product; and

- Manufacturers will also need to ship their products with the warning labels attached, or they are required to ship all the warning materials needed to the retailer.
